The privacy policy needs to be that of the operator of the service, probably the Canton Berne in this case.

I’m not aware of any privacy policy of Opendata.Swiss.

I can either add a link to https://opendata.swiss/en/legal-framework/ or https://opendata.swiss/en/terms-of-use/ would that be sufficient?
